Indians Turn to EB-5 Visa Route Amid Student Visa Crackdown

Washington D.C., June 1, 2025 — As stricter immigration policies continue to challenge international students seeking education in the U.S., many Indian families are exploring a new path to permanent residency—the EB-5 visa program.

Introduced by the U.S. Congress in 1990, the EB-5 Immigrant Investor Program offers foreign nationals a chance to obtain a Green Card by investing in the American economy. With student visa approvals becoming increasingly uncertain under tightened regulations that began during the Trump administration and have continued in some form, this lesser-known visa route is gaining traction.

So, what is the EB-5 visa exactly?

The EB-5 visa allows eligible investors—and their immediate families—to become lawful permanent residents by investing at least $800,000 in a U.S. business that creates or preserves 10 full-time jobs for American workers. While it was initially designed to stimulate the economy through job creation, the program has now emerged as an alternative gateway to the American dream, especially for those facing hurdles with traditional visas like the F-1 or H-1B.

For many Indian students and their families, the appeal lies in the direct path it provides to a Green Card—sidestepping years of uncertainty tied to work visas and the lottery-based system of the H-1B.

“Getting a student visa used to be straightforward, but now there are more rejections and tougher interviews. The EB-5 program gives us a sense of security,” says Rohan, an engineering student from Mumbai whose family recently began the EB-5 application process.

A Surge in Interest

Immigration consultants in India have reported a spike in EB-5 inquiries over the past three years. While the investment requirement is steep, families who can afford it see the long-term benefits in educational opportunities, job flexibility, and residency status.

“Earlier, most inquiries for EB-5 came from business families. Now we’re seeing professionals and even salaried parents willing to pool resources to secure their child’s future in the U.S.,” says Anjali Mehra, an immigration advisor based in New Delhi.

A Promising but Complex Route

While the EB-5 program is promising, it isn’t without its challenges. Delays in visa processing, evolving U.S. immigration laws, and the risk associated with the required investment demand careful planning and legal counsel.

Still, for many Indians navigating a complicated immigration landscape, the EB-5 visa offers hope—a legal, structured, and ultimately rewarding route to permanent residency in the United States.
